LEGALS FOR SUBMIT PHOTO FORM Prior to submitting your photo, please read the following terms and conditions. This confirms that any photo submitted to OURTRAVELPHOTOS.COM (hereafter "OTP"), shall be submitted for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged; in exchange for an assignment of the intellectual property rights to OTP. -Submissions must be original photographs, free of alteration or digital manipulation. -Submissions that contain identifiable individuals, must also provide appropriate waivers or releases such as the sample provided. -OTP has the right to publish any photo submitted in any media now known or developed in the future. This is primarily for the purpose of promotion and advertising. -OTP shall acknowledge all submissions by e-mail. All photos that are selected shall contain a credit to the photographer. -OTP shall have the right to alter any photo submitted and selected prior to publication; and OTP has no obligation to utilize for publication. -All finalists in any contest held by OTP, must provide original negatives and/or digital images as proof of compliance to the contest rules, before they shall be declared a winner. I, the undersigned (hereafter the "photographer"), agree to assign to OURTRAVELPHOTOS.COM INC. (hereafter referred to as "OTP"), all the rights regarding the photograph herein submitted to use on the website of OTP and in connection with advertising, publicizing, or exploiting the website and OTP by any means, media, devices, processes and technology now known or hereafter devised, in perpetuity throughout the universe. It is acknowledged the OTP shall have no obligation to utilize the photograph on the website, and that all Moral rights in the photograph are waived and shall never be enforced. I (we) confirm that the photographer has the authority to assign to OTP the right to use the Photo and that OTP's exercise of such rights shall not violate or infringe any rights of any third party. I hereby release OTP it's successors, assignees and licensees from any claim of any kind or nature whatsoever arising from the use of such photograph, including, without limitation, those based upon defamation, invasion of privacy, right of publicity, copyright or any other personal or property rights; and I agree that I shall not now or in the future assert or maintain any such claim against OTP, it's successors, assignees and licensees. I represent that I am the owner and/or authorized representative of the photograph, and that I have the authority to grant OTP the permission and rights herein granted, and that no one else's permission is required with respect the rights granted in this agreement.
